GENERAL TERMS AND CONDITIONS OF OSKAR-BEBEHUT INTERNATIONAL HOLDINGS LIMITED

§ 1 Scope and Provider

These General Terms and Conditions ("Terms") apply to all orders placed by consumers via the online shop at www.oskar-bebehut.com, operated by:

A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside his or her trade, business, or profession.

§ 2 Conclusion of Contract

§ 2.1 The depiction of products in the online shop constitutes an invitation to place an order and does not constitute a binding offer. By clicking on the "BUY NOW" or "CHECKOUT" button and completing the checkout process, you place a binding order for the respective goods. Our products are sold for private use and in normal household quantities unless otherwise agreed.

§ 2.2 We can accept your order by sending a separate order confirmation by email or by dispatching the goods. A confirmation of order receipt is sent immediately and automatically by email after the order is submitted and does not constitute an acceptance of the contract.

§ 2.3 If our order confirmation contains clerical or typographical errors, or if our prices as stated are incorrect due to a technical transmission error, we are entitled to cancel the order, whereby it is our obligation to provide proof of our error. In this case, any payments that have been made shall be reimbursed to you without delay.

§ 3 Prices

The prices quoted on the product pages are listed in the applicable local currency (USD for the United States, EUR for the European Union) and include all applicable taxes where required. Shipping costs are not included and will be displayed separately during the checkout process.

§ 4 Shipping Costs

§ 4.1 Shipping costs vary depending on the delivery destination, shipping method selected, and order value. Current shipping rates are calculated and displayed at checkout.

§ 4.2 We may offer free shipping promotions from time to time. The specific terms and qualifying order thresholds of such promotions will be clearly stated on the website during the promotional period.

§ 5 Terms of Delivery

§ 5.1 We currently offer delivery to the following regions:

  • United States: The contiguous 48 states and the District of Columbia. We do not currently ship to Alaska, Hawaii, P.O. Boxes, APO/FPO addresses, or US territories.
  • European Union: Germany, Austria, Denmark, Belgium, Netherlands, and Luxembourg.

§ 5.2 The estimated delivery time is stated on each product page and at checkout. Delivery times are estimates only and are not guaranteed. We shall not be liable for delays caused by carriers, customs, or other circumstances beyond our reasonable control.

§ 5.3 If one or more ordered products are out of stock, we reserve the right to make partial shipments at our own expense, if this is acceptable to the customer.

§ 5.4 If the products cannot be successfully delivered after three (3) attempts or if the delivery is returned to us due to an incorrect or incomplete address provided by the customer, we may cancel the order. In this case, any payments that have been made shall be reimbursed to you, less any actual shipping and return costs incurred.

§ 5.5 If the ordered product is not available because we were not supplied with this product by our suppliers or manufacturers through no fault of our own, we may cancel the order. In this case, we will inform you immediately and may suggest the shipment of a comparable product. If no comparable product is available or you do not want a comparable product, we will refund any payments you have made without delay.

§ 6 Terms of Payment

§ 6.1 Customers can choose to pay via the following methods (availability may vary by region):

  • Credit Card (Visa, Mastercard, American Express)
  • PayPal
  • Shop Pay
  • Apple Pay / Google Pay
  • Other payment methods as displayed at checkout

§ 6.2 Payment is processed at the time of order placement. For pre-order items, payment may be charged at the time of order or at the time of shipment, as specified on the product page.

§ 7 Reservation of Title

The goods remain our property until full payment has been made. Before transfer of ownership, any pledging, assignment as security, processing, or modification without our permission is prohibited.

§ 8 Return and Refund Policy

§ 8.1 We offer a 7-day no-questions-asked return policy. You may return the goods without giving any reason within 7 days of receipt, provided the products and original packaging are in undamaged, unused condition suitable for resale.

§ 8.2 After the initial 7-day period, limited returns may be available on a case-by-case basis. Please contact our customer service team for assistance.

§ 8.3 For all returns, the buyer is responsible for the return shipping costs. Items must be shipped to our designated return address (as communicated by our customer service team upon return authorization).

§ 8.4 Before returning the products to us, please contact us at dean@oskar-bebehut.com or amanda@oskar-bebehut.com in order to obtain a Return Authorization and the applicable return address. Please always include your order number when contacting us.

§ 8.5 The return policy does not apply to custom-made goods or products tailored specifically to the customer's individual needs and/or specifications.

For EU Customers — Right of Withdrawal

If you are a consumer within the European Economic Area, you have the right to withdraw from your contract within 14 days without stating any reasons, in accordance with the EU Consumer Rights Directive (Directive 2011/83/EU). The period of 14 days begins after receipt of the goods.

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event no later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the returned goods, or you have supplied evidence of having sent back the goods, whichever comes first.

You must return the goods to us without undue delay and in any event no later than fourteen days from the date on which you communicate your withdrawal. You bear the immediate costs of returning the goods. You are only liable for any diminished value of the goods resulting from any form of handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

§ 9 Product Warranty — 30-Day Quality Guarantee

§ 9.1 In addition to any statutory warranty rights you may have, we provide a 30-day quality guarantee from the date of delivery. If, within 30 days of receipt, the product exhibits manufacturing defects, missing parts, or other quality issues arising from normal use, we will, at our discretion:

  • Send replacement parts at no additional cost
  • Offer a partial refund proportional to the issue
  • Provide a free replacement product (for severe defects)
  • Offer a full refund

§ 9.2 To make a warranty claim, please contact us at dean@oskar-bebehut.com or amanda@oskar-bebehut.com with your order number and photographs or description of the defect. We may request additional information or the return of the defective product to verify the claim.

§ 9.3 This warranty does not cover damage caused by misuse, neglect, accident, unauthorized modification, improper installation, or normal wear and tear.

§ 10 Damage Incurred During Shipping

§ 10.1 Should you notice that the goods have been damaged during shipping, please report the damage without delay to the respective carrier and contact us as quickly as possible at dean@oskar-bebehut.com, including photographs of the damaged goods and packaging.

§ 10.2 Failure to file a complaint or to contact us does not have any influence on your legal warranty rights. However, by filing a complaint with the carrier and contacting us, you will help us assert our own claims against the carrier and/or our transport insurance and resolve your issue faster.

§ 11 Limitation of Liability

§ 11.1 Our products are designed for their intended use as described on the product pages. Users are responsible for ensuring the proper assembly, installation, and use of the products in accordance with the provided instructions.

§ 11.2 To the fullest extent permitted by applicable law, OSKAR-BEBEHUT INTERNATIONAL HOLDINGS LIMITED shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

§ 11.3 Nothing in these Terms shall limit or exclude our liability for death or personal injury resulting from our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

All content on this website — including but not limited to text, graphics, logos, images, product designs, and software — is the property of OSKAR-BEBEHUT INTERNATIONAL HOLDINGS LIMITED or its licensors and is protected by applicable intellectual property laws. OSKAR-BEBEHUT™ and BEBEHUT™ are trademarks of OSKAR-BEBEHUT INTERNATIONAL HOLDINGS LIMITED. No part of this website may be reproduced, distributed, or transmitted in any form without our prior written permission.

§ 13 Governing Law and Dispute Resolution

§ 13.1 For customers in the United States: These Terms and any disputes arising under or in connection with them shall be governed by and construed in accordance with the applicable federal and state laws of the United States. Any legal proceedings shall be brought in a court of competent jurisdiction in the state where the customer resides.

§ 13.2 For customers in the European Union: These Terms shall be governed by the laws of your country of residence, and you shall have the benefit of any mandatory consumer protection provisions of those laws that cannot be waived by contract.

§ 13.3 The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr/. We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board, but we will consider doing so on a case-by-case basis.

§ 14 Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

§ 15 Amendments

We reserve the right to amend these Terms at any time. Any changes will be posted on this page with an updated "Last Updated" date. Your continued use of the website following the posting of changes constitutes your acceptance of such changes.
